Terms of Service

These Terms of Service govern your use of Huna. Please read them before you create an account, buy a service or offer one.

1. About These Terms

  • These Terms apply to the website hunafreelance.com (the "Site"), which is operated by Huna LLC — referred to here as "Huna", "we" or "us".
  • By creating an account, browsing the Site, buying a service or offering one, you accept these Terms for yourself and for any company or entity you represent.
  • Our Privacy Policy and our Refund Policy are part of these Terms. Where the Refund Policy describes a refund in more detail, the Refund Policy applies.
  • If you do not accept these Terms, please do not use the Site.

2. Eligibility and Accounts

  • The Site is for people aged 18 and over. Someone aged between 13 and 17 may use the Site only through the account of a parent or guardian, who remains responsible for that use.
  • You must register with accurate information and keep it up to date.
  • You are responsible for your login details and for everything that happens under your account. Tell us immediately if you believe someone else has access to it.
  • We may ask you to verify your identity before you use certain features, and we may hold a feature back until that verification is complete.
  • Opening more than one account in order to get around a limit, a suspension or a fee is not allowed.

3. Buyers and Freelancers

  • The Site has two roles: a buyer who orders a service, and a freelancer who provides it. The same person may hold both roles.
  • Huna is a marketplace. The service itself is agreed between the buyer and the freelancer; Huna is not a party to that agreement, and is not the employer of any freelancer.
  • Freelancers work independently. They decide what they offer, at what price and on what delivery time, and they are responsible for any licence, permit or tax that applies to them.
  • Buyers are responsible for the accuracy of the requirements they submit and for the lawfulness of the material they share with a freelancer.

4. Gigs, Custom Offers and Orders

  • A freelancer publishes a service (a "gig") stating its price, delivery time, number of revisions and any add-ons.
  • A buyer either orders directly from the gig page or accepts a custom offer that a freelancer sends in chat.
  • A custom offer is valid only until the date the freelancer sets on it. Until then it is open, and it may be accepted, declined or withdrawn by the freelancer. Once its validity date passes, the offer expires and can no longer be accepted.
  • When a buyer declines a custom offer, they may state a reason — the price, the timeline or another reason — which is shown to the freelancer.
  • An order is created once payment is made. The buyer then submits the order requirements, and the delivery time begins from that point.
  • An order may be cancelled before delivery in the cases described in section 8.

5. Payments, Fees and Currency

  • All orders are paid through the Site. Payments are handled by our payment service provider, Stripe, and card details are given to that provider, not to Huna.
  • For the sole purpose of collecting payment, Huna acts as the freelancer's limited agent. Payment made to Huna settles the buyer's obligation towards the freelancer, and it is then Huna's responsibility to pass the amount to the freelancer under these Terms.
  • A service fee is added to the order and is shown to you at checkout before you pay. It is currently 20% of the order subtotal, or a flat 3 US dollars on orders of 15 US dollars or less.
  • A fee is also deducted from the freelancer's side, so the freelancer receives 80% of the order value.
  • Any balance you hold on Huna is applied automatically to your next purchase.
  • Prices on the Site are set in US dollars. If another currency is displayed, the conversion is carried out by the payment service provider, the rate may change from day to day, and the final amount is shown before you confirm.
  • Offering to pay, or agreeing to be paid, outside the Site is not allowed. Please report any such request to support.
  • You agree to receive invoices and payment receipts electronically, by email or through the Site.
  • Each user is responsible for their own taxes. Where the law requires it, Huna may add an indirect tax to what a buyer pays, or withhold an amount from what a freelancer earns.

6. Delivery, Revisions and Approval

  • The freelancer delivers the agreed work through the order page by the agreed date. An order that passes its delivery date is marked as late.
  • After delivery, the buyer has 72 hours to accept the delivery or request a revision. If neither happens within that time, the order is approved automatically.
  • The number of revisions is the number stated on the gig, and it may be none. A revision request is for the work that was agreed, not for additional work.
  • Requesting extra work through a revision request, or holding back a delivery in order to ask for more money, is a breach of these Terms.
  • Once an order is approved, the buyer and the freelancer may rate each other. A rating must reflect a real experience on a real order.

7. Freelancer Earnings and Withdrawals

  • The freelancer's earnings are credited when the order is approved, and they enter a clearance period of 10 days before they become available to withdraw.
  • To withdraw, the freelancer adds a payout method. Each field of a payout method is validated against the type it is declared with, and a payout method may be linked to only one account.
  • Fees and processing times differ from one payout method to another, and are shown when the withdrawal is requested.
  • Once a withdrawal has been submitted it cannot be reversed or cancelled.
  • We may pause withdrawals on an account while we look into a suspicion of fraud, a report from another user, or several accounts sharing one payout method.
  • Earnings on a closed or disabled account may be withdrawn after a safety period of 90 days, once ownership of the account has been confirmed.

8. Cancellations, Disputes and Refunds

  • We ask buyers and freelancers to resolve a disagreement between themselves on the order page first. If that does not work, either side may raise a dispute on the order or contact support.
  • Huna may cancel an order where these Terms have been breached, where the delivery system has been misused, or where fraud is suspected.
  • When an order is cancelled, the amount paid is returned to the buyer's balance on Huna. Moving that balance back to the original payment method is covered by the Refund Policy.
  • An order may still be cancelled while the funds are in the clearance period described in section 7. After that period, a cancellation is only possible in exceptional cases reviewed by support, and the amount is then deducted from the freelancer's balance or from future earnings.
  • An order is not cancelled because of taste alone: if the delivery matches what the gig described, the disagreement is about quality, not about delivery.
  • Opening a chargeback or a dispute with your bank before contacting support is a breach of these Terms and may lead to your account being suspended.
  • Rights in the delivered work pass to the buyer only once payment has been completed. If the payment is reversed, the work may not be used.

9. Communication and Prohibited Conduct

  • Keep your communication about an order on the Site. It is the record support relies on if something goes wrong.
  • Phone numbers, email addresses and messaging handles are blocked in chat and cannot be sent. Repeated attempts are counted on your account and may bring it to review.
  • Asking another user to move the conversation, the work or the payment off the Site is not allowed for either side.
  • The following are also not allowed: fraud or deception, harassment or threats, anything unlawful, infringing someone else's rights, spam, misleading listings, fake or traded reviews, threatening a bad rating to obtain something extra, and using another person's account.
  • We may remove content, cancel an order or restrict an account when this section is breached.

10. Content and Intellectual Property

  • You keep ownership of what you upload. You grant Huna a licence to host it, display it and use it to present and promote the Site and your listing.
  • What is delivered in an order is transferred to the buyer on full payment, on the terms stated on the gig page, including any separate terms for commercial use.
  • A freelancer must own, or be licensed to use, everything they deliver. Delivering material taken from someone else without permission is a breach of these Terms.
  • The Huna name, logo and the content of the Site belong to Huna and may not be used without our permission.

11. Identity Verification

  • We may ask you to submit identity documents, and we may do so before allowing a withdrawal or a feature that carries a higher risk.
  • Documents submitted for verification are handled as described in the Privacy Policy and are shared only where it is needed to complete the check.
  • If a verification is not completed, or the documents cannot be confirmed, we may limit or close the account.

12. Privacy

  • The Privacy Policy explains what we collect, why we collect it, who we share it with and how long we keep it. It forms part of these Terms.
  • Messages sent in chat are scanned automatically for contact details, as described in section 9 and in the Privacy Policy.

13. Suspension and Termination

  • We may warn, limit, suspend or close an account that breaches these Terms, and we will say why unless the law prevents us.
  • You may close your account at any time. Orders already in progress, and obligations that arose before the closure, are not cancelled by it.
  • When an account is closed, cleared earnings may be withdrawn under section 7, and any amount still owed to Huna or to another user remains due.

14. Disclaimer of Warranties

  • THE SITE, ITS CONTENT AND ANY SERVICE OBTAINED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
  • NEITHER HUNA NOR ANYONE CONNECTED WITH HUNA WARRANTS THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY OR AVAILABILITY OF THE SITE, OR THE RESULT OF ANY SERVICE BOUGHT THROUGH IT.
  • THIS SECTION DOES NOT SET ASIDE ANY WARRANTY THAT THE LAW APPLICABLE TO YOU DOES NOT ALLOW TO BE SET ASIDE.

15. Limitation of Liability

  • HUNA, ITS AFFILIATES, ITS SERVICE PROVIDERS AND ITS STAFF ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR YOUR INABILITY TO USE IT, INCLUDING LOSS OF PROFIT, BUSINESS, GOODWILL OR DATA.
  • BECAUSE HUNA ACTS ONLY AS THE FREELANCER'S LIMITED PAYMENT COLLECTION AGENT, HUNA IS NOT LIABLE FOR WHAT A FREELANCER DOES OR FAILS TO DO.
  • THIS SECTION DOES NOT SET ASIDE ANY LIABILITY THAT THE LAW DOES NOT ALLOW TO BE EXCLUDED OR LIMITED.

16. Changes to These Terms

  • We may update these Terms from time to time, and the updated version is published on this page.
  • Where a change is significant, we will make a reasonable effort to tell you before it takes effect.
  • Continuing to use the Site after an update means you accept the updated Terms.

17. Language

  • These Terms are published in Arabic and in English. The two versions are equally binding, and we maintain them so that they say the same thing, section for section.
  • If you believe the two versions differ on a point, please tell us at support@hunafreelance.com so we can correct the text.
